Data protection officer

Collected data
Almond Institute limits the collection of personal data to the strict minimum. The personal data collected are processed according to secure protocols.
This data is processed on the following legal bases:
- Performance of the contract or pre-contractual obligations
- The performance of a contract
- The legitimate interest of the data protection officer and in particular the promotion of the activities of the training organization
- Consent
Purposes of the processing
We use the personal data collected for the following main purposes:
- Creation of user accounts on the BYCE platform
- Registration of participants for distance learning and on-site training
- Training follow-up
- Collection of customer satisfaction
- Development of a customer contact database
- Marketing and business development operations
Recipients of personal data
The personal data collected for the creation of user accounts on the BYCE platform and for the follow-up of the training are transmitted to our Almond Institute collaborators involved in the creation of user accounts on the BYCE platform and in the follow-up of the trainings, the commercials and the IT support.
Personal data collected on the basis of the fulfilment of pre-contractual obligations and in particular the registration of participants for distance learning and on-site training is passed on to the Almond Institute employees responsible for managing the registration of participants for distance learning/on-site training sessions and to the Almond accounting department.
Personal data collected on the basis of the execution of a contract is passed on to Almond Institute employees, sales representatives, Almond Institute’s accounting department and the certification organization.
Personal data collected on the basis of legitimate interest, and in particular the promotion of the activities of the Almond Institute training organization, is passed on to Almond sales representatives and consultants.
Personal data collected on the basis of legitimate interest, including the development of a customer contact database, is shared with Almond’s sales, consulting, accounting and billing departments.
The personal data collected on the basis of consent for marketing and commercial prospecting operations are passed on to the people in charge of the marketing department and to Almond’s sales representatives.
Transfer of data outside the European Union
All personal data are hosted in France and in Europe. Thus, no transfer of personal data outside the European Union is made.
However, if our hosting contracts change and your personal data needs to be transferred to subcontractors located outside the European Union, we will ensure that the transfer of such data is governed by standard contractual clauses drawn up by the European Commission or, more generally, by legal mechanisms for governing data transfers outside the European Union.

To guarantee the confidentiality of your personal data, we must ensure your identity before responding to you. Thus, any request to exercise your rights must be accompanied by a copy of your identity card.
A reply will be sent to you within one month from the date of receipt of your request. Given the complexity of your request or the large number of requests we receive, this period may be extended to two months.
If you are not satisfied with the response provided, you may file a complaint with the CNIL: complaints.
Data conservation period
Your personal data is kept for a period of time in accordance with applicable laws or proportionate to the purposes for which it was collected. In addition, your personal data may be kept for a longer period of time when required by legal and regulatory obligations.

Rules of procedure
Scope of application
These rules apply to all trainees for the duration of the course. Each student is considered as having agreed to the terms of these rules when attending training at Almond Institute and agreeing that action will be taken against him/her in the event of non-compliance with these rules.
In accordance with article R.6352-1 of the French Labor Code, when training takes place in an establishment that already has internal regulations, the safety and hygiene measures applicable to trainees are those of the latter regulations.
Bases of the Internal Regulations
These Rules of procedure are updated in accordance with changes in legislation, and in particular the provisions of Decree 2019-1143 of November 07, 2019 (Article 4). It complies with the provisions of articles L.6352-3 and 5 and R.6352-1 to 15 of the Labor Code. Penalties are set out in articles L.6355-8 and 9 of the Labor Code. These rules of procedure are available and can be consulted by all trainees before they enter the course.
Information given to the trainee before the final registration

- The operational objectives and content of the training.
- The list of trainers for your course.
- The schedules.
- The methods of evaluation of the training.
- Your contact information in case of need.
- The rules of procedure applicable to the training
- Prices.
- The terms of payment and the financial conditions provided for in the event of early termination of the training or withdrawal during the course.
Furthermore, the information requested, in any form whatsoever, by a training organization from the candidate for an action as defined in article L6313-1 of the French Labour Code, from a trainee can only be used to assess his or her ability to follow the training action, whether it is requested, proposed or continued. This information must have a direct and necessary link with the training action, and it must be answered in good faith.
Outsourcing
Almond Institute reserves the right to outsource the creation, animation and/or organization of its training activities. We are committed to maintaining the level of quality that meets Qualiopi with all our internal and external teams.
How to register (access to the training)
The registration procedures are specified on the training sheets. A registration is “intuitu personae”. No trainee can take the place of another, except with the prior agreement of Almond Institute (profile and needs validation).
Attendance, commitment and abandonment
Trainees are required to attend all sessions scheduled by the training provider, with regular attendance (and punctuality in the case of on-site training) and without interruption. Almond Institute undertakes to formalize and archive the proof of completion of training activities and to send the trainee, at the end of the course or on request, a certificate of completion.
Any absence of the trainee, whether or not he/she is also the client, and for whatever reason, must be announced and declared in writing, on a blank sheet of paper or by e-mail.
The provisions of article L6354-1 will apply (Article L6354-1 CT: In the event of total or partial non-performance of a training service, the organization providing the service shall reimburse the co-contractor any sums unduly received as a result).
However, any training started is due in full. A compensation fee will then be charged as compensation (which means that the financial support will be cancelled).
Discipline, guarantees and sanctions
Documentation: The educational documentation provided during the training sessions is protected by copyright and may not be used other than for strictly personal use. Their reproduction by any process whatsoever is prohibited.
Responsibility of the organization for personal belongings: the training organization declines any responsibility in case of loss, theft or deterioration of personal objects of any kind, left by the trainees in the training premises.
At Almond Institute, we assume that you are an adult, responsible and will behave professionally.
- Correct dress and behaviour
- Active participation in individual and group sessions (including intersessional sessions if necessary)
- Respect for the equipment, premises or software provided
- No alcohol, drugs on site + no smoking except in reserved areas
If necessary, Almond Institute can issue a reminder of the rules and we will find a solution so that everyone can leave with satisfaction.
In any case, the prevention of accidents and illnesses is imperative and requires everyone to fully comply with all applicable health and safety regulations. To this end, the general and specific safety instructions in force, when they exist, must be strictly respected under penalty of disciplinary sanctions.
Any action considered wrongful by Almond Institute may, depending on its nature and seriousness, be subject to one or other of the following sanctions in order of importance:
- Written notice
- Blame
- Temporary or permanent exclusion from the course
Safety
Accident: Any accident or incident occurring during the course of training must be immediately reported by the trainee or witnesses of the accident to the head of the training organization or his representative. In accordance with article R.6343-3 of the French Labor Code, any accident that occurs to a trainee while he/she is at the training site or while he/she is on his/her way to or from the training site must be declared by the training organization’s manager to the Social Security Fund.
Fire instructions: Fire instructions and in particular a map showing the location of fire extinguishers and emergency exits are posted in the training premises so that they are known by all trainees. They are required to carry out the evacuation order given by the course leader or by an employee of the establishment without delay. The instructions, in force in the establishment, to be observed in case of danger and especially of fire, must be scrupulously respected.
Representation of trainees
Representation of trainees : election and ballot (according to the provisions of articles R6352.9 to 12 of the Labor Code, some of which were modified by Decree 2019-1143 of 07/11/19) (Art. The delegates make any suggestion to improve the course of the training and the living conditions of the trainees in the training organization. They present individual or collective complaints relating to these matters, to health and safety conditions at work and to the application of internal regulations. (Art. R6352.15)
The provisions of this section (Articles R.6352.3 to R6352.14) do not apply to prisoners admitted to participate in a vocational training program.
Claim procedure
Prospects, clients, trainees and the various parties involved in the training action have the possibility at any time to make a complaint relating to the training offers and services of the Organization.
Each complaint will be studied and a response will be given to the sender as soon as possible.
The present internal regulations come into force on September 7, 2021, and replace all previous versions.
